Grocery Store Premises Liability Case Settles for $2M Using Animated Storyboard
As consumers, we visit stores and other places of business on a regular basis. It can be assumed that any place of business that welcomes the public would make an effort, and has a responsibility, to provide a safe atmosphere to their customers. Patrick Kang’s client was picking up some groceries when she turned the corner of an aisle. Unfortunately, a box of items to be stocked on the shelves was left right at the edge of the aisle, tripping Kang’s client as she made the turn. Her foot struck the box and she fell to the ground. She sustained injuries to her legs and arms, but also to her spine, which resulted in herniated discs and has caused lingering, permanent injuries. She has suffered through many pain management injections in her neck, eventually being told that she would need surgery. As the main earner in her family, however, she could not afford to take time off for the surgery and recovery.
Mr Kang had received an offer of $400K at mediation, which was not enough, and knew he needed some convincing graphics to increase the offer, or to take to a jury if the case went to trial. He reached out to Focus Graphics because he had success using an animated storyboard with an earlier case and wanted something similar for this one. An animated storyboard is a low-cost option that serves as the base for a full animation should a case go to trial and something more polished is desired. The storyboard created shows the client walking through the grocery store and tripping over the box, and integrates actual photos of the client’s injuries. The addition of this graphic to the case was instrumental in resolving the case, settling for $2M for his client.
