Highway Collision Results in $1M Settlement
A tractor-trailer should never stop on the shoulder of a major highway. Doing so poses a grave danger to the motoring public. In the trucking industry, these semi-trucks are referred to as sitting ducks. If a semi-truck does stop on the shoulder, when the driver is ready to re-enter the highway, he should at a bare minimum wait for a large enough gap to safely pull out into the lane of travel. Daisy Chaparro’s client was driving on I-10 in El Paso, TX when a semi truck that had been parked on the shoulder pulled into his lane of travel while the plaintiff travelled at full highway speed. This action pushed him into another semi traveling in the next lane, causing severe injuries to his spine, brain, right hip, right knee, and left shoulder.
The defense argued that Ms. Chaparro’s client should have seen the semi entering the highway, and shouldn’t have even been on the road due to an expired driver’s license. She came to Focus Graphics for a number of colorizations to assist the expert in explaining her client’s injuries. We also suggested an injury summary report that would tie them all together in one exhibit. They were preparing for trial and were able to show the defense how all injuries would be explained to a jury. The defense had claimed they would never pay close to the policy limits, but these graphics helped change their position, and the case ultimately settled for policy limits of $1 million.
