$315K Offer to $4M Verdict in Auto Collision Case
Driving requires a knowledge of basic traffic laws – when to stop, when to go, right of way, etc. The expectation is that anyone with a license knows and abides by these laws. Alex Ledbetter’s client found that this is not always the case when he approached an intersection that had 4-way flashing red lights, essentially the same as a 4-way stop. He stopped, then proceeded through the intersection when it was his turn. Unfortunately, another driver did not stop as they were supposed to and violently crashed into Ledbetter’s 81-year old client, causing his car to careen into the stoplight pole. His injuries were quite severe – several broken ribs, a fractured pelvis, neck injuries, and an open wound on his leg that later required surgery. He spent the months following the crash going from hospital to rehab to his son’s home. His goal was to become independent again. He suffered much pain and hardship throughout his long journey of rehab to regain his strength and mobility, but never gave up, eventually returning home to live on his own.
The defense argued that, while the crash and his injuries were unfortunate, Ledbetter’s client was partially to blame, and tried to diminish the damages, stating that he had a good recovery and was back to living a normal life. Mr. Ledbetter came to Focus Graphics for some exhibits that would really show their client’s injuries. A couple of colorized CT images and an injury summary were suggested, showing the major injuries, including actual imaging and photos. Although the defense put forward $315K as their last official offer, they recommended only $125K at trial. The jury took very little time in returning a verdict for $4 million in favor of the plaintiff with 100% of the fault attributed to the defendant.
