$5,000 Offer to $10M Verdict in Auto Collision Case
Defendants often try to minimize a plaintiff’s injuries and the lifelong effects caused by their transgressions. In the case of Yosha Law’s client, she was in a violent collision caused by a Frito-Lay North America employee driving a pick-up truck, who seemed to be trying to stay close to a company truck. The client was only 47 years old and her severe talus fracture rapidly progressed to post-traumatic arthritis, leading to a future of mobility limitations. Although her medical bills were fairly low, her long-term physical and emotional losses were profound. The defendant initially offered $5000 at mediation, at which point Yosha Law immediately terminated discussions, choosing to let a jury decide what was fair and reasonable compensation.
The Yosha Law team, led by Brandon Yosha, reached out to Focus Graphics to create meaningful exhibits to help tell their client’s story. These included a mechanism of injury animation, showing the crash; several colorizations of imaging to show the severity of the injury; and a surgical animation to explain what it took to fix the injury and why it would limit her mobility. These supported the team’s efforts to humanize their client for the jury, helping them to understand the non-economic damages and lifelong effects of this collision on her mobility, independence, and quality of life.


While Frito-Lay North America later increased its offer to $200,000, it was not sufficient. The jury rejected their attempts to minimize the plaintiff’s suffering and delivered a unanimous $10 million verdict that reflected the true magnitude of her loss.
