How Incorporating Dashcam Video and Animation Helped Secure a Historic $21 Million Semi-Truck Settlement in Kansas

Few cases are more devastating than those involving the loss of a child. For trial attorney Tom Dickerson, one of the most heartbreaking cases of his career involved a family whose lives were forever changed when a commercial semi-truck slammed into the back of their vehicle.

The family had come to a stop on a Kansas highway while preparing to make a left-hand turn into their family business. What should have been an ordinary day ended in tragedy when a tractor-trailer traveling approximately 67 miles per hour crashed into the rear of their truck. The collision claimed the lives of a father and his seven-year-old child, leaving behind a grieving family searching for answers and accountability.

Using crash evidence, vehicle data, dashcam videos, roadway analysis, and expert findings, the animation reconstructed the events leading up to the collision and gave a visual account that words alone could not.

One of the most impactful aspects of the animation was the ability to expand the timeline of the crash. Rather than focusing only on the moment of impact, the animation zoomed out to show the full sequence of events leading up to the collision. Jurors, mediators, and insurance representatives could see how long the tractor-trailer had been traveling at highway speed, how much distance was available for the driver to recognize stopped traffic, and how much time existed to take evasive action. 

The animation also highlighted a critical fact uncovered during the investigation: the truck’s cruise control remained engaged, the driver was highly distracted by his phone, and the vehicle never meaningfully slowed before impact. By visually demonstrating the truck’s speed, distance, and lack of reaction, the animation illustrated the extent of the negligence in a way that was immediate, understandable, and difficult to dispute.

In commercial trucking cases, fractions of seconds and hundreds of feet often determine liability. While those concepts can be difficult to communicate through testimony alone, a forensic animation allows viewers to see the evidence unfold in real time. Effective demonstrative evidence transforms technical information into a story that decision-makers can understand, evaluate, and remember.

For Dickerson, the visual presentation became an essential tool in demonstrating the true scope of the tragedy and the responsibility of the trucking company involved. The animation helped establish not only what happened, but what should have happened had the driver exercised reasonable care.

The case was ultimately resolved for approximately $21 million, the largest wrongful death settlement in Kansas history, applying Kansas law, involving a tractor-trailer collision. The outcome provided accountability for the family and underscored the growing importance of accident reconstruction, demonstrative evidence, and courtroom animation in modern trucking litigation.
