Highway Collision Case Settles for $450K

An entry point onto a highway is a place where a driver should always be extra-attentive…vehicles traveling on the highway are going very fast, so ensuring plenty of space to cross or merge is imperative. For Michael Chaloupka’s client, he had no way to avoid the collision when a vehicle pulled out right in front of him while he was traveling on a highway. His vehicle t-boned the one that was trying to cross the highway, then sent him into the guardrail for a second impact. While fortunate to have avoided life-threatening injuries, the vehicle was totaled and the client was transported to the hospital with overall pain, abrasions, and severe pain in his right knee. Follow-up with his PCP was not helpful, so he went on to see two separate knee surgeons, both who diagnosed a torn ACL and meniscus.

The surgery, performed about 8 months after the crash, and post-op therapy, were successful; however, Mr. Chaloupka’s client still suffers from “pilot-light” pain…it’s always there in the background and occasionally flares up into more severe pain in his right knee. While retired from his career of photography, he still did odd photo jobs here and there, as well as enjoyed umpiring youth softball games. This injury prevented him from umpiring for about 1.5 years. Offers from the defense were not adequate, so Mr. Chaloupka came to Focus Graphics for colorizations of the imaging, as well as an animation of the surgery so the defense, a mediator, or if necessary, a jury could see what his client went through. The case ended up settling at mediation in favor of the plaintiff in the amount of $450,000.
