Strong 6-Figure Settlement in Bicycle vs Motor Vehicle Collision

Bicyclists have the same rights and responsibilities as a motorist on the highway, yet many motorists are often inattentive or violate the rules of the road. There are a great number of bicycle commuters in San Diego, CA, young and old. One such young man was hit by a careless motorist and knocked to the ground where his helmet sustained moderate damage. He initially experienced headaches, fatigue, and nausea, and over the following days and weeks he began to show more deficiencies consistent with a TBI. His family even took him back to the emergency room because some of the symptoms were affecting his daily activities. His medical team documented his complaints, which did not resolve. His doctors believed he was suffering from Persistent Symptoms after Concussion. He consistently experienced nausea, fatigue, eye strain, severe headaches, decreased focus and memory, cognitive strain, photophobia, and more. His college schoolwork was affected and he eventually had to take a break from school to aid in his recovery.

His family reached out to Richard Duquette, a SoCal attorney who specializes in bicycle injury cases. He partnered with Arthur D’Egidio, Esq. and Irving Pedroza, Esq., and they put the case together to prepare for trial. They were successful in resolving the underlying policy limits claim, but due to the ongoing deficits their client was experiencing, they knew he’d need more medical care. Mr. Duquette reached out to Focus Graphics, who he had successfully worked with before on another bicycle head injury case, to create some powerful exhibits for mediation. It was decided to combine images of the damaged helmet with an illustration of how a coup-contrecoup injury occurs, as well as compiling the symptoms he was experiencing in a deficits exhibit. This included witness declarations from both family and the medical team, some being direct quotes from his medical records, to support the deficits. Mr. Duquette credits Brian Panish, Esq. for this technique which was learned by watching Mr. Panish’s record-breaking jury trial in Vista, CA. Between Mr. Duquette, Mr. D’Egidio, and Mr. Pedroza, the team effort paid off and they were able to settle shortly after mediation for a strong 6-figures against a national insurance company.

When I was retained, I knew immediately we needed powerful demonstrative exhibits to tell the client’s story, as trained by Mr. Gerry Spence, Esq., founder of the prestigious Trial Lawyers College in Wyoming. I had previously used Focus Graphics and knew their team would be the right partner to economically create what we wanted to show what our client had gone through and is still experiencing today. Focus Graphics is highly skilled, with Noreen identifying the best way to communicate the deficits, and did a great job connecting the family declarations to support the medical evidence. Art D’Egidio and Irving Pedroza were instrumental in collecting the evidence. Altogether, we had an effective team that led to justice. Focus Graphics’ illustrations were instrumental in presenting the damages in our case. We got more for our client by investing in the services of Focus Graphics. It was clearly worth the money and it added substantial value to our client’s recovery. With the increased competition in the personal injury arena, hiring Focus Graphics will give you an edge and a happy client.
